Welcome to our terms and conditions of sale and delivery!
The following Terms and Conditions, as in force on the date of order, shall exclusively apply to the pre-contractual and contractual relationship between (a) website Shop4biz operated by TMT Ltd, whose registered office is located at zk Mladost, bl.113 A, vh.5 Varna, 9000, Bulgaria, when acting as Seller of the products on this website (“Seller”, “we”, “us”) and (b) you (the “Buyer”, “you”, “your”) for the purchase of products by you.
These Terms and Conditions will supersede any and all other terms and conditions contained in or referred to in order(s), in correspondence or elsewhere and this notwithstanding any provisions to the contrary in such other terms and conditions. The Seller reserves the right to amend these terms and conditions at its sole discretion. Please, do check them from time to time to be advised of our Terms and Conditions. We will notify you of significant changes in an appropriate way.
How to order ? Placement of order and Contract conclusion
- Select the goods you require from the Website, choose the quantity of goods you wish to purchase (the default will be one (1) unit) and click ‘Add to basket’.
- Review your cart/basket and make sure all specifications fit your requirements, then click “Checkout”.
Placing the order, the Buyer may review and change the order related data at anytime in the shopping basket area of the Site. The Buyer may identify and correct input errors at anytime, before finally submitting the order by clicking the “submit order” button, by reviewing the order and the price, reviewing the details of each product and selecting or deselecting a product.
Orders may be placed and transmitted only if the Buyer accepts these Terms and Conditions by placing a checkmark in the appropriate check box, thereby including them into his/her offer. - If you are a new user, you will need to enter an email address and create a username and password. You must keep your username and password confidential as they allow access to your account. To continue setting up an account you will need to enter your personal details, billing address (which must correspond with your payment card address) and delivery address.
- Once you have set up an account, you will be directed to the shipping confirmation and delivery options page where you may enter voucher codes, select the type of delivery, and vary delivery and/or billing addresses.
- You will then proceed to the payment page where you may select the payment type and complete your order. Your payment will be collected from you by TMT Ltd. Following submission of your order you will be sent an automated order acknowledgement to the email address provided. You will receive an email confirming that Shop4biz has accepted your order when your order has been processed and is ready for delivery by Shop4biz.
This order confirmation does not constitute acceptance of the offer, but is only intended to inform the Buyer that we received his/her order. A contract of sale shall be concluded only when we ship the ordered product to the Buyer and confirm shipping with a second e-mail (shipping confirmation).
By placing an order through the Website, you warrant that you are legally capable of entering into binding contracts.
The contract to sell goods to you only relates to those goods listed in the confirmation email.
Product description and Prices
A description of the main characteristics of goods can be found on the product pages of the Website. We will take all reasonable care to ensure that descriptions, photos, details and prices of the products appearing on the Site are accurate at the time they are entered onto the system. Is always possible that, despite our best efforts, some of the products listed on our Site may be incorrectly priced or described.
Product prices are in EUR (main currency) and are stated exclusive of delivery charges which will be indicated separately on our Site and before order completion.
If a Product’s correct price is higher than the price stated on our Site, we reserve the right to cancel your order prior to sending you shipping confirmation (as defined above) or to supply it at the previously indicated price.
Prices and offers may vary and may only be available for limited periods. All prices and offers are subject to availability and may be withdrawn or amended at our discretion. The prices on the Website may differ to prices in our retail stores, catalogues or elsewhere.
Data protection and privacy
Any personal information provided to us will be processed in accordance with our privacy policy.
Returns & Exchange
As consumer, the Buyer has the right to notify the Seller that he/she waives the purchase, without penalties and without indicating any motive, within fourteen (14) calendar days as of the day following the delivery of the product.
The delivery cost for the return of the products (i) if no fault is found with the products will be paid by the Buyer. All products must be unopened and unsealed and there shouldn’t be any sign of use.
The Buyer has no right to waive his/her purchase if it is unsealed.
You may (a) exchange the products, or obtain a full refund if the products in your order are damaged or faulty upon receipt, or (b) if the products you have received are not the products you originally ordered.
When exchanging damaged or faulty products or incorrect deliveries, we will dispatch replacement items to you free of charge or we offer an adequate and fair solution with your best interest in mind.
When returning damaged or faulty we will refund (to the original credit or debit card account used to make the online purchase):
a) the full purchase price;
b) the delivery charges incurred in delivering the products to you (where only part of an order is returned to us, we may reduce the amount of the delivery charge we refund you to account for the delivery costs of those items sent to you and not returned); and
c) the shipping costs to return the products to us;
Provided you first return the products in your order to us in the condition in which you received them. If you fail to return products to us we may charge you for the products or the cost incurred in collecting them from you.
The above provisions do not affect your statutory rights.
Method of Payment
You may pay by Bank Transfer or PayPal. Please ensure if you are using a credit card that you provide the card holder’s name as it is shown on the card, and the billing address corresponds as it appears on the card statement. Payment will be taken in EUR and if applicable, you will be charged according to the exchange rate at that time.
Delivery Options
Shop4biz offers the following options for orders : via UPS, InOut and DPD courier services or regular postal service for international orders. All items are insured by the Seller until they have been delivered to your address.
Shop4biz will use third party couriers. Couriers will require a signature to ensure safe receipt of your goods.
Delivery times depend on the delivery service selected and the types of goods ordered. Shop4biz always aims to dispatch all goods in stock as quickly as possible. The maximum delivery lead time for goods is 30 days unless specifically agreed by Shop4biz with you.
The Buyer shall not be entitled to compensation or contract cancellation due to a delay in delivery, unless the delay was caused by the Seller or its supplier, and can be attributed to wilful misconduct or gross negligence. If the delay in delivery exceeds thirty (30) business days, the Buyer shall be entitled to withdraw from the contract and shall be refunded of the payments already effected.
Risk
The products will be delivered to the place of delivery specified in the Seller’s shipping confirmation. Risk of loss, damage and theft of the products transfers to the Buyer upon delivery and from there on.
Products shall remain the property of the Seller until complete and final payment of the purchase price including any transportation charges.
Intellectual property rights
Unless otherwise specified the intellectual property rights in the contents of all the pages in this website, are owned or licensed to Shop4biz, or are used with permission from the owner.
The contents of this website may not be copied, reproduced, modified, downloaded or used in any form without our prior written permission.
Complaints
Shop4biz takes all feedback very seriously and aims to deal with complaints as quickly and effectively as possible.
For complaints relating to orders placed through the Website please email customer services. To assist Shop4biz in dealing with your complaint, please detail all aspects of the complaint, your order number and your contact details.
